03-25-09 Planning Commission Agenda with supporting materials

WEDNESDAY, MARCH 25, 2009, AT 5:00 P.M.

Items scheduled at a specific time cannot be heard earlier than at the scheduled

time per the Nevada Open Meeting Law Requirements. A dinner recess may be

taken. If a dinner recess is taken, any unfinished business will be heard after the

meeting is resumed.

This is the tentative schedule for the meeting. The Planning Commission reserves the right to take items in a different order to accomplish business in the most efficient manner.

D. Public Comments

Members of the public who wish to address the Commission may approach the podium and speak on matters related to the Planning Commission, but not on items on the agenda for this meeting. Comments are limited to three minutes per person or topic. If your item requires extended discussion, please request the Chairman to calendar the matter for a future Planning Commission meeting. No action may be taken on a matter raised under this item of the agenda until the matter itself has been specifically included on an agenda as an item upon which action may be taken.

E. Staff Public Service Announcements

Announcements of a general nature for the Commission and for public information regarding planning, zoning and land use. Not intended for detailed discussion or for items already on the agenda.

F. Disclosures

Any member of the Commission may wish to explain any contact with an applicant or the public regarding an item on the agenda or business of the Commission.

G. Consent Agenda

All matters listed under the consent agenda are considered routine and may be acted upon by the Planning Commission with one action and without an extensive hearing. Any member of the Commission or any citizen may request that an item be taken from the consent agenda, discussed and acted upon separately during this meeting. The Chairman or Vice Chairman retains discretion in deciding whether or not an item will be removed from the consent agenda.


H. Public Hearing Matters

The following items are scheduled for a public hearing. The Chairman will read the Agenda listing into the public record. Staff will present a summary of the staff report and recommendations, including any updated information that was received after the date when staff reports were distributed. The Commission will follow with questions of staff. At that time, the Chairman will open the hearing to public testimony. Normally, the applicant and/or their representative are permitted to speak first, followed by Commission questions. This will be followed by the Chairman requesting comments from the public at large. If you wish to speak on a particular item, please limit your comments to three (3) minutes and be as brief and concise as possible so that all who wish to speak, may do so. Do not repeat the position of others who express the same views as yourself. The Chairman has the right to establish time limits for comments and to allow for rebuttal. In order to be part of the administrative record regarding an appeal of an item, you must sign the "sign in" sheet on the podium or have previously sent correspondence to the Planning Division or spoken to staff regarding an item on this agenda.

H-1 SUP-06-068(a)* Action to review SUP-06-068(a) (property owner: Carson City Christian Fellowship) in compliance with condition of approval #32, which states that this Special Use Permit shall be reviewed at the March 2009 Planning Commission meeting to ensure compliance with the Special Use Permit and the Growth Management Ordinance as well as a request for a 1,200 square foot storage building, on property located at 1635 Clearview Drive, APN 010-191-22. (Heidi Eskew-Herrmann)

Summary: The original applicant, RO Anderson Engineering (representing the property owner), received a Special Use Permit to construct a church on this property, which is zoned Single Family One Acre (SF1A). The applicant agreed to meet 33 conditions of approval. This review will ensure compliance with these conditions of approval as well as the Growth Management Ordinance. The applicant is also seeking approval of a 1,200 square foot storage building as part of this review.

H-2 MISC-09-014 Action to accept and recommend to the Board of Supervisors acceptance of the recommendations of the Silver Saddle Ranch and Carson River Charrette Summary, Creating a Community Vision, regarding the planning vision for public recreation and open space opportunities on the Silver Saddle Ranch, Prison Hill area and along the Carson River. (Lee Plemel and Juan Guzman, Open Space Manager) Part 2  Part 3

Summary: The Friends of Silver Saddle Ranch organization, in cooperation with the Carson City Parks and Recreation Department, BLM and the National Park Service, conducted several public workshops in the spring of 2008 to develop a recreation and open space plan for the public lands in the subject area. The vision document is intended to guide future decisions by Carson City regarding the use of these lands.

H-3 ZCA-09-012 Action to make a recommendation to the Board of Supervisors on a Zoning Code Amendment, an ordinance amending the Carson City Municipal Code Title 18, Zoning, Chapter 18.16, Development Standards, Division 4, Signs, Section 4.4.(7), Administration, Exceptions, to modify the regulations relating to political signs, and other matters properly related thereto. (Lee Plemel)

Summary: At the advice of the District Attorney’s office, the proposed amendment would eliminate time limits for displaying political signs, which could be deemed to violate free-speech provisions of the U.S. Constitution.

H-4 MISC-09-016 Action to take public comments regarding the 5-year Consolidated Plan and the 2009-2010 Annual Action Plan. (Lee Plemel)

Summary: The U.S. Department of Housing and Development (HUD) requires that recipients of Community Development Block Grant (CDBG) funds provide opportunities for citizen participation by encouraging citizens to participate in the development of the Consolidated Plan and Annual Action Plan. The Consolidated Plan is created every five years and describes community needs, resources, priorities, and proposed activities to be undertaken under certain HUD programs. The Annual Action Plan is a yearly plan that describes the specific planned uses for HUD programs.
