01-27-10 Planning Commission Agenda with Supporting Materials

WEDNESDAY, JANUARY 27, 2010, AT 5:00 P.M.

Items scheduled at a specific time cannot be heard earlier than at the scheduled

time per the Nevada Open Meeting Law Requirements. A dinner recess may be

taken. If a dinner recess is taken, any unfinished business will be heard after the

meeting is resumed.

A. Roll Call, Determination of a Quorum and Pledge of Allegiance

B. Commission Action - Approval of Minutes

C. Modification of Agenda

This is the tentative schedule for the meeting. The Planning Commission reserves the right to take items in a different order to accomplish business in the most efficient manner.

D. Public Comments

Members of the public who wish to address the Commission may approach the podium and speak on matters related to the Planning Commission, but not on items on the agenda for this meeting. Comments are limited to three minutes per person or topic. If your item requires extended discussion, please request the Chairman to calendar the matter for a future Planning Commission meeting. No action may be taken on a matter raised under this item of the agenda until the matter itself has been specifically included on an agenda as an item upon which action may be taken.

E. Staff Public Service Announcements

Announcements of a general nature for the Commission and for public information regarding planning, zoning and land use. Not intended for detailed discussion or for items already on the agenda.

F. Disclosures

Any member of the Commission may wish to explain any contact with an applicant or the public regarding an item on the agenda or business of the Commission.

G. Consent Agenda

All matters listed under the consent agenda are considered routine and may be acted upon by the Planning Commission with one action and without an extensive hearing. Any member of the Commission or any citizen may request that an item be taken from the consent agenda, discussed and acted upon separately during this meeting. The Chairman or Vice Chairman retains discretion in deciding whether or not an item will be removed from the consent agenda.

H. Public Hearing Matters

The following items are scheduled for a public hearing. The Chairman will read the Agenda listing into the public record. Staff will present a summary of the staff report and recommendations, including any updated information that was received after the date when staff reports were distributed. The Commission will follow with questions of staff. At that time, the Chairman will open the hearing to public testimony. Normally, the applicant and/or their representative are permitted to speak first, followed by Commission questions. This will be followed by the Chairman requesting comments from the public at large. If you wish to speak on a particular item, please limit your comments to three (3) minutes and be as brief and concise as possible so that all who wish to speak may do so. Do not repeat the position of others who express the same views as you. The Chairman has the right to establish time limits for comments and to allow for rebuttal. In order to be part of the administrative record regarding an appeal of an item, you must sign the "sign in" sheet on the podium or have previously sent correspondence to the Planning Division or spoken to staff regarding an item on this agenda.

H-1 SUP-09-094* Action to consider a Special Use Permit request from Project One (property owner: Carson City Parks and Recreation) to allow an indoor pitching and batting practice facility on property zoned Public Regional (PR), located at 500 Evalyn Dr., APN 004-016-03. (Kathe Green)

Summary: Request to allow construction of a building to be used for indoor pitching and batting practice at the existing Governor’s Field facility, to allow year round baseball activity on the site. The proposed building would be 100 feet long by 60 feet wide by 30 feet high and would be located on the northeast portion of the property.

H-2(A) SUP-09-096* Action to consider a Special Use Permit request from Darren Berger (property owner: Anderson/Veverka Family Trust) to allow residential multi-family apartments on property zoned General Commercial (GC), located at 291 Rhodes St., APN 009-031-21. (Jennifer Pruitt)

Summary: This request will allow three multi family apartment units within an existing building on site. Multi Family Apartments are a conditional use within the General Commercial zoning district. The existing building was constructed in the 1980’s.

H-2 (B) VAR-09-097* Action to consider a Variance application from Darren Berger (property owner: Anderson/Veverka Family Trust) to modify the setback requirements for multi family dwelling units in a non-residential zoning district, adjacent to a residential zoning district, on property zoned General Commercial (GC) located at 291 Rhodes St., APN 009-031-21. (Jennifer Pruitt)

Summary: The Carson City Development Standards 1.18, Residential Development Standards in Non-Residential Districts requires a minimum setback of 20 feet, if adjacent to a residential zoning district, with an additional 10 feet for each story above one story, for a total required rear yard setback of 30 feet. The existing structure was built in the 1980’s and has an existing setback of 7 feet 6 inches. The Variance request would vary 22 feet 6 inches from the required rear yard 30 foot setback. The proposed Variance request will not result in an expansion of the existing building on site.
